Unless otherwise specified on the Site, you may employ the normal functions of your browser to download and print a single copy of individual Content files for such use, provided that you retain all copyright and other proprietary notices associated with the Content. 3. Third Party Rights. We grant the foregoing limited permission under copyrights we own. Copyrights and other rights in the Content may also be held by other individuals or entities, in images reproduced on the Site. While we have endeavored in good faith to obtain from such third parties the rights we believe necessary to include their works on the Site, we do not represent or warrant that use of the Content displayed on the Site will not infringe or violate the rights of third parties. You are solely responsible for obtaining all permissions from third parties that may be necessary for any use of the Content you wish to make.
4. Prohibited Uses. You are prohibited from copying, displaying, publishing, distributing, transmitting, modifying, performing or otherwise using or exploiting any of the protected Content on the Site for any commercial purpose or for the purpose of making it publicly available. 5. Permission Requests. To request image-use permission, under rights controlled by us, please contact the Archaeological Exploration of Sardis at 617-495-3940 or email@example.com. The credit line must be included as specified (©Archaeological Exploration of Sardis/ President and Fellows of Harvard College) for each image reproduced, including the copyright notice. Unless otherwise stated, the permission is for single-use, single-language reproduction rights. Additional language editions, subsequent editions and other reuse of the Authorized Image(s) must have written permission of the AES.
Reproductions of the Authorized Image(s) may not be used for advertising or promotional purposes without additional permission. Each Authorized Image of the Objects must be reproduced in its entirety; no cropping is permitted without prior approval. A specific detail must be indicated in the picture caption. Over-printing on a reproduction is not permitted.
The fee for single-use permission is $100 for each digital image, payable prior to publication. Payment will not be refunded in the event of non-use of the permission to publish. Please make checks payable to the Archaeological Exploration of Sardis.
Digital Authorized Image(s) must be deleted promptly. If the Authorized Image(s) is to be reproduced in color, color proofs may be requested before publication.
Licensee must provide one complimentary copy of the completed project (or online access) as published. In addition, prior to publication AES may require Licensee to provide AES with samples of the Authorized Image(s) as they are to appear. AES shall have the right to approve the samples for quality and adherence to any guidelines of AES, and Licensee shall not use the Authorized Image(s) until the samples have been so approved.
As noted above, you are also responsible for obtaining any permissions under third party rights you may need.
7. Disclaimer of Warranties. THE SITE AND THE CONTENT ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND ANY THIRD-PARTY CONTENT PROVIDERS OR LICENSORS (“CONTENT PROVIDERS”) DISCLAIM ALL WARRANTIES OF ANY KIND (EXPRESS, IMPLIED OR OTHERWISE) REGARDING THE SITE OR THE CONTENT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OWNERSHIP, AND NON-INFRINGEMENT. NEITHER WE NOR ANY CONTENT PROVIDER MAKES ANY WARRANTY ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, TIMELINESS, SUFFICIENCY OR QUALITY OF THE SITE OR THE CONTENT. 8. Limitations of Liability and Remedies. YOUR USE OF THE SITE AND THE CONTENT IS AT YOUR OWN SOLE RISK. If you are dissatisfied with the Site or the Content, your exclusive remedy is to stop using the Site and the Content. 13. Applicable Law and Jurisdiction. The Site (excluding links) is controlled and operated from our facilities in and around Cambridge, Massachusetts. While we have made no effort to publish the Site elsewhere, because the Site is published on the World Wide Web it is accessible in all fifty states and other countries. As each of these places has laws that may differ from those of Massachusetts, and as you and we benefit from establishing a predictable legal environment in which to publish, access and use the Site, by accessing or using the Site you agree that all matters arising from or relating to the use and operation of the Site will be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflicts of laws principles.
